Terms and Conditions
Last updated: 12 August 2026
1. Who We Are
These Terms and Conditions ("Terms") govern your use of the website www.pinchincollection.com (the "Site") and any purchase you make through it. The Site is operated by Pinchin Collection ("we", "us", "our").
Lilly Pinchin Racing Limited is a company registered in England and Wales under company number 17345705, with its registered office at Bath Mews, Bath Parade, Cheltenham, England, GL53
By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Definitions
-
"Order" means a request by you to purchase Products through the Site.
-
"Products" means the goods offered for sale on the Site.
-
"Contract" means the legally binding agreement between you and us for the sale of Products, formed in accordance with clause 4.
-
"Consumer" means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
3. Eligibility and Account
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an Order. If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. Notify us immediately at info@pinchincollection.com if you suspect unauthorised use of your account.
4. Products, Pricing and Order Acceptance
We take reasonable care to ensure product descriptions, images and prices on the Site are accurate. However, slight variations in colour, texture or finish may occur, particularly for handmade or vintage items, and we do not guarantee that your device will display colours accurately.
All prices are shown in GBP and are inclusive/exclusive of applicable taxes as indicated at checkout. Delivery charges are shown separately during checkout before you complete your Order.
We reserve the right to correct pricing or listing errors at any time before an Order is accepted. Placing an Order does not guarantee acceptance. A Contract is formed only when we send you an order confirmation email confirming dispatch (or otherwise confirming acceptance) of your Order. Until that point, we may decline or cancel an Order — for example, where a Product is unavailable, where there has been a pricing error, or where we suspect fraud — and any payment taken will be refunded in full.
5. Payment
Payment is processed securely through third-party payment providers, which may include Stripe and PayPal. We do not store your full card details on our servers. By placing an Order, you confirm that the payment details provided are valid and that you are authorised to use the chosen payment method.
Full payment is taken at the time of Order unless otherwise stated at checkout.
6. Delivery
We deliver to the countries listed at checkout. Estimated delivery times are provided for guidance only and are not guaranteed. Risk in the Products passes to you on delivery. For Consumers, ownership of the Products passes to you once we have received payment in full and the Products have been delivered.
International orders may be subject to import duties, customs charges or local taxes levied by the destination country. These charges are your responsibility and are not included in the price you pay us or in our delivery charges. We recommend checking with your local customs authority before ordering.
If your delivery is delayed by an event outside our control, we will let you know as soon as possible and take steps to minimise the delay.
7. Your Right to Cancel (Cooling-Off Period)
If you are a Consumer ordering from within the UK or EU, you have a statutory right to cancel your Contract without giving a reason within 14 days of receiving your Products, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (or the equivalent EU Consumer Rights Directive provisions applicable in your country). To exercise this right, contact us at [CONTACT EMAIL] before the deadline.
If you cancel under this right, you must return the Products to us within 14 days of telling us you wish to cancel, at your own cost unless the Products are faulty or not as described. We will refund the price paid, including standard delivery charges, within 14 days of receiving the returned Products or evidence that you have sent them back, whichever is earlier.
This statutory right does not apply to Products made to your specification or clearly personalised, or to goods which are liable to deteriorate rapidly, except where such Products are faulty.
8. Returns and Refunds Policy
In addition to your statutory cancellation rights above, we offer a 14-day returns policy on most Products. If you are not satisfied with your purchase, you may return it to us within 30 days of delivery for a refund or exchange, provided that:
-
the Product is unused, unworn and in its original condition and packaging, with tags attached where applicable;
-
you provide proof of purchase (order number or confirmation email); and
-
the Product is not excluded from returns under clause 8.3.
To start a return, contact us at info@pinchincollection.com with your order number. We will confirm the return address and process. Return shipping costs are the customer's responsibility unless the Product is faulty, damaged on arrival, or not as described, in which case we will cover reasonable return shipping costs and offer a full refund or replacement.
Approved refunds are issued to your original payment method within 14 days of us receiving the returned Product, or of receiving evidence that it has been sent back. We will notify you by email once your return has been received and processed.
If a Product arrives faulty, damaged or incorrect, please contact us within [7] days of delivery with photographs where possible, so we can arrange a replacement, repair or refund at no cost to you.
9. Consumer Guarantees
Nothing in these Terms affects your statutory rights as a Consumer. Under the Consumer Rights Act 2015 (UK) and equivalent consumer protection legislation in the EU, Products must be as described, fit for purpose and of satisfactory quality. If a Product does not meet this standard, you may be entitled to a repair, replacement, price reduction or refund in addition to the rights set out in these Terms.
10. Intellectual Property
All content on the Site — including text, graphics, logos, product photography, and the Pinchin Collection name and branding — is owned by us or our licensors and is protected by copyright, trade mark and other intellectual property laws. You may not copy, reproduce, republish or exploit any content from the Site for commercial purposes without our prior written consent.
11. Prohibited Use
You agree not to use the Site: for any unlawful purpose; to transmit harmful code or malware; to attempt unauthorised access to our systems; to scrape or harvest data without consent; or in any way that could damage, disable or impair the Site or interfere with other users' enjoyment of it.
12. Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
Subject to the above, we shall not be liable for any indirect or consequential loss, loss of profits, loss of business, or loss of opportunity arising out of or in connection with your use of the Site or purchase of Products. Where you are purchasing as a Consumer, our total liability to you in connection with any Order is limited to the price you paid for the relevant Products.
We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including events of force majeure.
13. Third-Party Links and Services
The Site may contain links to third-party websites or use third-party services (such as payment processors and analytics providers). We are not responsible for the content, accuracy or practices of third-party sites, and your use of such sites is at your own risk and subject to their own terms.
14. Changes to These Terms
We may update these Terms from time to time, for example to reflect changes in our business practices or legal requirements. The version in force at the time you place an Order will apply to that Order. We will post the updated Terms on this page with a revised "Last updated" date.
15. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), are governed by and construed in accordance with the laws of England and Wales.
If you are a Consumer, you may bring proceedings in connection with these Terms in the courts of the country in which you are resident, in addition to the courts of England and Wales. If you are a business customer, the courts of England and Wales shall have exclusive jurisdiction.
EU-based Consumers may also be entitled to use the European Commission's Online Dispute Resolution platform, available at ec.europa.eu/consumers/odr, to resolve disputes without going to court.
16. Contact Us
